Notice of Privacy Practices

At Sportcare Rehabilitation Inc., d/b/a Curnyn Physical Therapy, we are committed to protecting your privacy. This Notice describes how your medical information may be used and disclosed and how you can access this information. Please review it carefully.

1. Our Responsibilities

We are required by law to maintain the privacy of your protected health information (PHI), provide you with this Notice, and follow its terms. We comply with the HIPAA Privacy Rule, the Texas Medical Records Privacy Act, and federal confidentiality rules for substance use disorder treatment records under 42 CFR Part 2. We will also notify you if a breach involving your unsecured PHI occurs.

2. How We May Use and Disclose Your Health Information

We may use or disclose your PHI for the following purposes without your written authorization:

  • Treatment: To provide, coordinate, or manage your physical therapy and related healthcare services.

  • Payment: To obtain payment for services, verify insurance coverage, or coordinate benefits.

  • Healthcare Operations: For quality assessment, training, licensing, audits, compliance activities, and business management.

  • Other Uses Permitted or Required by Law: We may disclose PHI when required by federal, state, or local law; for public health activities; to avert a serious threat to health or safety; for workers’ compensation; for health oversight activities; or in response to a court order that meets legal requirements.

3. Uses and Disclosures Requiring Your Written Authorization

We must obtain your written authorization before using or disclosing your PHI for:

  • Marketing communications not permitted by law.

  • The sale of PHI.

  • Most uses of psychotherapy notes (if applicable).

  • Any other use or disclosure not described in this Notice.

You may revoke an authorization at any time in writing.

4. Special Protections for Certain Types of Information

Some categories of information receive additional protection under federal or Texas law. These include HIV-related information, genetic information, mental health records, and alcohol and/or substance use disorder treatment records. We follow all special confidentiality protections that apply to these records.

5. Substance Use Disorder Treatment Records (42 CFR Part 2)

Federal law provides heightened confidentiality for records related to federally assisted substance use disorder (SUD) diagnosis, treatment, or referral. These rules apply when we receive SUD information from a Part 2 program.

  • How We May Use or Disclose Part 2 Records: We may use or disclose your Part 2 records only as permitted by your specific written consent, your general consent when allowed under the updated rule, or a limited exception permitted by federal law.

  • Prohibition on Legal Use Against You: We will not use or disclose your Part 2 records in any civil, criminal, administrative, or legislative proceeding against you without your written consent or a qualifying court order.

  • Redisclosure Restrictions: Any disclosure we make that includes Part 2 information will include a notice stating that further redisclosure is prohibited unless permitted by federal law.

  • When We Receive Part 2 Records: If we receive SUD treatment information from another provider, we will handle it according to the consent under which it was provided and will not use or disclose it beyond what the consent or law allows.


6. Your Rights Regarding Your Health Information

You have the right to:

  • Right to Inspect and Copy: You may request to review or obtain a copy of your PHI, including electronic copies.

  • Right to Request Amendments: You may request corrections to your PHI if you believe it is inaccurate or incomplete.

  • Right to Request Restrictions: You may request limits on how we use or disclose your PHI. We are not required to agree, except when you pay out-of-pocket in full and request that we not disclose information to your health plan.

  • Right to Request Confidential Communications: You may request that we contact you at a specific phone number, address, or email.

  • Right to an Accounting of Disclosures: You may request a list of certain disclosures we have made of your PHI.

  • Right to a Paper or Electronic Copy of This Notice: You may request a paper copy at any time, even if you received this Notice electronically.

7. Our Duty to Notify You of a Breach

We will notify you without unreasonable delay and no later than 60 days following the discovery of a breach, as required by the HIPAA Breach Notification Rule and applicable Texas law.

8. Changes to This Notice

We reserve the right to change this Notice and make the revised Notice effective for all PHI we maintain. The updated Notice will be available in our office and on our website.

9. Questions or Complaints

If you have questions or believe your privacy rights have been violated, you may contact our Privacy Officer. You will not be penalized for filing a complaint.
